Terms of Service

The service

NativeTrainer: Chinese Tones is a Mandarin tone and pronunciation training product. The main path is a gated practice map organized by the 24 solar terms (listen and speak drills). Optional older practice tracks (Hear It / Say It / Link It style packs) may also be available in the app. It is a training tool, not a school, certificate, visa document, or personal tutoring contract.

Accounts and age

You must be at least 13 (or 16 in the EEA if that higher age applies) and able to enter a contract. Keep your login safe. You are responsible for activity on your account.

Plans, prices, and auto-renewal

• Free: solar-term gates 1–10 on the trainer map (clear each gate in order to unlock the next), and the first pack on each optional Hear It / Say It / Link It track, without payment.
• Monthly Premium: $9.99 per month, billed in advance, auto-renews until you cancel.
• Lifetime: $59.90 one-time (the price shown at checkout is the price you pay).
• On the website, checkout and invoices run through Freemius. In the Google Play app, digital purchases use Google Play Billing only. In the iOS app, digital purchases use Apple In-App Purchase only. We do not open Freemius checkout inside the store apps. Taxes may be added where required.

What “lifetime” means

“Lifetime” is a license to Premium features on NativeTrainer: Chinese Tones for as long as we continue to operate this product as a commercial service. It is not a promise that servers will run forever, that the company (or a successor) will exist in perpetuity, or that a specific feature roadmap is guaranteed.

• Includes: unlocking solar-term trainer gates from gate 11 onward; unlocking premium pronunciation packs on optional Hear It / Say It / Link It style tracks available now; and premium packs we later add to this same product.
• Includes: practice audio recorded by native Mandarin speakers on our developer team — not text-to-speech or spliced single-syllable clips.
• Does not include: a second, unrelated app we might launch under another name; ownership of our code or brand; a transferable resale right; or a guarantee against shutdown, domain change, or a reasonable migration.
• If we discontinue NativeTrainer: Chinese Tones, we will try to give notice to the email on your account. Remaining prepaid monthly time is handled under Refunds below; lifetime is not a cash-value balance.

Refunds and cancellation

Where you bought matters:

• App Store: cancel or manage auto-renewal in Settings → Apple ID → Subscriptions (or Account → Manage subscription in the app). Refunds for App Store purchases follow Apple’s refund policies and tools.
• Google Play: cancel or manage auto-renewal in Google Play → Payments & subscriptions (or Account → Manage subscription in the app, which opens Play). Refunds for Play purchases follow Google Play’s refund policies and tools.
• Website (Freemius): cancel auto-renewal anytime in Account → Manage subscription (Freemius customer portal). Access continues until the end of the period you already paid for. We do not refund or prorate a month that has already started, except where consumer law requires otherwise.

Lifetime and other one-time purchases: this is digital content. Premium is unlocked to your account as soon as payment succeeds. Except where consumer law requires a refund, or we failed to deliver access, or we charged you in error (including a duplicate charge), website one-time orders are final. We do not offer a cooling-off refund, a “change of mind” refund, or a refund because you used the product for only a short time. App Store and Play one-time purchases follow Apple’s and Google Play’s rules respectively.

EEA/UK consumers: you may have a 14-day withdrawal right for distance contracts. By completing checkout you ask us to start Premium immediately. You acknowledge that once Premium is unlocked to your account, you may lose that withdrawal right for this digital content (subject to mandatory law and, for Play purchases, Google’s process).

Chargebacks / disputes: email us first at obeulah36@gmail.com if something is wrong. We may suspend an account that disputes a valid, delivered website charge without contacting us.

Microphone

Speak / record-and-compare features use the microphone on your device only. Recordings are not uploaded to us. You must not record other people without their permission.

Practice audio

All learner-facing practice clips are recorded by native Mandarin speakers on our developer team for NativeTrainer: Chinese Tones. We do not use open-collection third-party voice libraries for practice playback, and we do not use text-to-speech for practice audio. Words and phrases are recorded as whole utterances — we do not splice single-syllable clips into words.

The practice UI, copy, trainer structure, packs, and NativeTrainer: Chinese Tones brand are ours. Do not scrape or redistribute our content as a competing product.

Acceptable use

• No sharing a paid login as a public “group account”.
• No attacking, scraping at abusive scale, or reverse-engineering to steal content.
• No using the service for unlawful content.

Availability and disclaimer

We aim for the app to stay up, but we do not warrant uninterrupted access or that practice will produce any exam score. The service is provided “as is” to the extent allowed by law. Nothing in these terms limits rights that consumer law does not let you waive.

Privacy and account deletion

How we handle personal data is in the Privacy Policy. In the iOS or Android app, open Settings → Account → Delete account. You can also email obeulah36@gmail.com from the address on your account with the subject “Delete my account”, or use Contact. Organizations should also read the DPA.

Governing law

These terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your country of residence still apply where they cannot be waived. Before filing a claim, please email us so we can try to resolve the issue.
